2. Eligibility and agreeing to these terms
You must be at least 18 years old and legally able to enter into these terms. Read these terms and the AI limitations before sending a message. The send-message notice explains that sending a message indicates agreement to these terms. If you disagree, do not submit messages. The Privacy notice explains data use separately.
Keep sign-in links and account access secure. Tell us promptly about suspected unauthorised access. Do not share an account or impersonate another person. We do not currently verify age using identity documents.
3. What ChatWithAI provides
The service offers fictional AI conversation characters, a private character designer and a source-based weekly public-figure spotlight. Public chat generates responses using Ollama Cloud and the selected fictional character or source context. Portrait generation is a separate live AI feature, started only when you request it.
AI outputs may be wrong, incomplete, outdated or unsuitable. They are not a guarantee, professional advice, or a decision made on your behalf. Check important facts, calculations, deadlines and cited sources independently. A source card shows a reference; it does not prove every statement. See the full limitations.
Characters are fictional adult AI roles, not people, therapists or a replacement for human relationships. A public-figure spotlight is an unaffiliated AI interpretation for discussion and entertainment. Its Imagined response mode is hypothetical, not a real quotation, endorsement or statement of that person’s private views. Public record mode is limited to the displayed sources. Weekly selections are editorial choices, not a verified popularity ranking.
4. Fair use and content rules
You may use ChatWithAI only lawfully and without interfering with other people or the service. You must not:
- Submit content you have no right to use, or unlawfully disclose someone else’s personal or confidential information.
- Use it for fraud, impersonation, harassment, unlawful discrimination, exploitation, sexual content involving minors, or instructions intended to harm people.
- Distribute malware, bypass access controls, extract credentials or private data, or test security without our written permission.
- Evade allowances, create accounts to abuse free access, resell access without permission, or use automated traffic that disrupts the service.
- Represent a response as verified professional advice or deliberately mislead people about its origin or accuracy.
Please minimise personal information and avoid special-category data, passwords, payment-card details and information about children. Use anonymised examples where possible.
5. Inputs, outputs and intellectual property
You retain your rights in material you submit. You give us permission to process, store and transmit that material only as needed to provide the requested service, secure it and comply with law, as described in our Privacy notice. This is not a general licence to publish your conversations or use them for model training.
To the extent permitted by law and third-party rights, you may use responses for your own purposes. Outputs may be similar to those supplied to other users, and may contain material protected by someone else’s rights. We cannot grant rights we do not own or guarantee that every output qualifies for copyright protection. Check rights before publication or commercial use.
Spotlight photographs are used with a recorded licence or permission and attribution. Where suitable reuse rights are not established, the service can generate an original editorial illustration from verified event facts. Illustrations are labelled and are not photographs or evidence of the event. Generating a new image does not automatically remove third-party rights.
Our branding, application design, software and original materials remain ours or our licensors’. These terms permit use of the service; they do not transfer ownership of that material.
6. Allowances and proposed subscriptions
The preview guest allowance is 20 completed replies in a rolling 24-hour period, including at most 1 source check. Free accounts offer 50 completed replies per UK calendar day, with 1 source check included. Email account sign-in is available.
Signed-in users may generate one successful new fictional-adult portrait in each rolling seven-day period. You may switch between available saved portraits and the default at any time. Failed generation does not consume the weekly allowance; retry and overall capacity limits still apply. Availability depends on the image provider, and generation can take several minutes. Do not use this feature to impersonate real people or produce misleading endorsements. Generated images carry no guarantee of uniqueness, likeness accuracy or exclusive rights.
Proposed Plus pricing is £7.99 per month for 600 completed replies and 60 source checks per billing period. Plus is not currently for sale. A new conversation does not reset your allowance. Source checks count within the total; technical failures release the reply allowance, while stopping after useful partial content can use a reply.
Before any payment is enabled, checkout will state the final total price, taxes where applicable, billing period, renewal, cancellation, service description and applicable withdrawal rights. You will not be charged for this preview. The Cancellation & refunds page explains the current position. Any paid launch requires reviewed payment terms and a separate clear purchase action.
7. Availability, suspension and ending use
We use reasonable care in providing the service but cannot promise uninterrupted access or error-free outputs. Maintenance, capacity limits and events outside our reasonable control may interrupt it. Save a copy of material you need.
We may restrict access where reasonably necessary to address a breach, security risk, abuse or legal obligation. Where practical and lawful, we will explain the reason and allow you to contact us to challenge an error. Urgent action may be necessary to protect users or the service. Suspension does not remove statutory refund or other consumer rights.
You may stop using the preview at any time. Data export and deletion are available in Settings. Ordinary subscription cancellation and deleting an account have different effects, described on the cancellation page.
8. Liability and your statutory rights
Nothing in these terms excludes or limits liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any liability that cannot lawfully be excluded. Your statutory consumer rights and data protection rights remain in place.
If you are a consumer, we are responsible for loss or damage that is a reasonably foreseeable result of our breach of these terms or failure to use reasonable care and skill. We do not seek to exclude rights or remedies under the Consumer Rights Act 2015. We are not responsible for unforeseeable losses or losses caused by your unlawful misuse, subject always to applicable law.
If you use the service for business purposes, and only to the extent the law permits, our total liability arising from the service is limited to the greater of £100 and the fees you paid us for the service in the preceding 12 months. In that business context we exclude indirect or consequential loss and loss of profit, revenue or business opportunity. These business provisions do not apply to consumers or override the exclusions from limitation in the first paragraph.
AI limitations describe known risks. They do not excuse a failure by us to meet legal obligations or remove a remedy required by law.
9. Changes to the service or terms
We may make reasonable changes for legal, security or operational reasons. We will identify the current version and provide reasonable notice of material changes where practicable. Changes do not retrospectively remove rights, change a completed purchase or impose a new payment obligation. Material paid-plan changes will need appropriate notice and cancellation options. Mandatory legal or urgent security changes may take effect sooner.
10. Complaints, law and disputes
Email info@chatwithai.co.uk with the issue and any relevant date or reference. Do not send passwords or full card details. You can also write to our registered office. We will investigate fairly and explain our response; contacting us does not limit your right to seek other remedies.
These terms are governed by the law of England and Wales, subject to mandatory protections that apply where you live. UK consumers may bring proceedings in the courts of their home part of the UK, including Scotland or Northern Ireland. Business disputes are subject to the courts of England and Wales. No mandatory arbitration or waiver of statutory rights is required.
